DM Gestão Terms of Service

The service

DM Gestão is a web system for the clinical, operational, document and financial management of healthcare clinics. Each clinic is a company of the system, with its own team, settings and data, isolated from the other clinics.

The system is a management tool. It does not give medical advice, and it does not replace the judgment of the professionals.

Accounts and access

• The account is personal: its e-mail and password must not be shared. The same account can take part in more than one clinic.
• The administrators of each clinic invite its team, grant the permissions and dismiss the people who leave, and answer for these choices.
• The clinic can require a second login factor. Lost factors are reset only through the flows of the system.
• Any suspected unauthorized access must be reported right away.

Responsibilities of the clinic

• Have a legal basis under the LGPD to register and process the data of its patients, and inform them about it.
• Keep the registered data correct, and answer the requests of its patients, using the tools the system offers.
• Answer for the clinical content its professionals write, sign and issue: records, prescriptions, certificates and documents.
• Make sure its professionals are qualified and duly registered in their councils.

Digital signatures

Records and prescriptions are signed with the ICP-Brasil certificate (A1 or A3) of the professional, which belongs to the professional and must be valid and carry their CPF. The legal validity of a signature depends on the certificate used.

Subscription and payment

• The use of the system may be charged by a recurring subscription per clinic, paid on Stripe, with the price and start date agreed with the clinic.
• Without a valid subscription after the start date, the clinic enters a read-only mode: its data can still be viewed and exported, health records stay available, and the LGPD requests keep working.
• The subscription can be canceled at any time on the payment portal, and stays active until the end of the paid period.

Data of the clinic

The data registered by a clinic belongs to the clinic. BomLabs processes it only to provide the service, as described in the Privacy Policy, which is part of these terms. The clinic can export its data at any time.

Acceptable use

• Use the system only for the management of the clinic, under the law and the ethics codes of the professions.
• Do not try to reach data of other clinics, get around the access controls or overload the service.
• Do not upload files that are illegal, malicious or that the clinic has no right to keep.

Availability and changes

BomLabs works to keep the system available and secure, but it may be unavailable during maintenance or because of failures of its providers. The system may change and gain or lose features over time.

End of use

A clinic may stop using the system at any time, and BomLabs may deactivate a clinic that breaks these terms. Health records are kept for the legal retention period even after the end of the use, as described in the Privacy Policy.

Limitation of liability

To the extent allowed by law, BomLabs is not liable for indirect damages or for decisions taken from the information registered in the system, which is the responsibility of the clinic and its professionals.

Governing law

These terms are governed by the laws of Brazil.

Changes to these terms

When these terms change, the new version is published on this page with a new update date, and relevant changes are informed to the administrators of the clinics. Using the system after a change means accepting the new terms.
